FDA halts Amgen study after teen patient death

(AP) ? Federal health regulators have halted Amgen's studies of its drug Sensipar after the death of a 14-year-old patient in a company trial.

The Food and Drug Administration said Tuesday it is still gathering information about the death, but has shut down all studies of the drug in children.

Sensipar is approved in adults to treat over-activity of the parathyroid gland, which can lead to brittle bones, kidney stones and abdominal pain. It has been used since 2004 to treat symptoms of chronic kidney disease and parathyroid cancer.

Amgen Inc. had been studying the drug to see whether it works in children.

The Thousand Oaks, Calif.-based company said in a statement that it "is working as rapidly as possible to understand the circumstances of what happened."

The FDA said on its website that it is unclear whether Amgen's drug had a role in the patient's death, but it is reminding doctors to prescribe it carefully.

The drug is known to lower calcium levels, sometimes to a dangerous extent.

The agency says doctors should monitor patients' calcium levels monthly to make sure they don't fall to dangerous levels. Signs of a calcium deficiency include muscle cramping, convulsions and burning or prickling sensations.

The most common side effects of the drug in adults include nausea, vomiting and diarrhea.

Amgen reported annual sales of $800 million for Sensipar in 2011, its most recent full-year financial report.

Company shares fell 7 cents to $89.48 in afternoon trading Tuesday.

Barclays loses "confidential" treatment of regulatory fight

WASHINGTON (Reuters) - Details of Barclays' fight with the U.S. energy regulator over alleged power market manipulation will be made public now that officials have rejected the investment bank's claim the probe is a publicity stunt.

Barclays Plc had said the Federal Regulatory Energy Commission was pursuing a case against the bank "to garner additional publicity for its own enforcement activities while seeking to portray Barclays negatively," according to an August filing from the bank that has just been made public.

The regulator found that Barclays manipulated the California power market from late 2006 to 2008 and should pay $470 million in fines.

According to the FERC, the British bank and four of its traders used losses in physical markets to make gains in financial markets and they knew their activity was unlawful.

Barclays has challenged the regulator's finding in a series of filings and sought "confidential" treatment of some elements of its defense.

Two weeks ago, the FERC rejected Barclays bid for confidentiality and about a dozen briefs were made public on the regulator's website late on Monday.

The battle over the record fine is becoming a test of the FERC's authority to protect consumers and investors from wrongdoing in energy markets.

Among other things, the FERC investigation uncovered trader banter that the British bank has termed "unfortunate." The four traders boasted in emails and instant messages about how "fun" it was to "crap on" physical power prices on the West Coast.

Bank defenders argue that more trades add healthy liquidity to the market and are in the interests of consumers.

Congress in 2005 expanded the FERC's powers in the wake of the Enron electricity manipulation scandals in the western United States earlier in the decade.

If Barclays continues to fight and there is no settlement, the dispute is expected to land in federal court.

Officials at Barclays declined to comment.

Barclays was last year fined about $450 million for rigging a key benchmark lending rate.

Vatican calls reports of conspiracy by Italian media 'completely false'

Since Pope Benedict XVI announced his resignation the Italian media has speculated there could be more to the story, and has written unflattering stories about the Vatican's administration. On Saturday, the Vatican accused the Italian media of spreading false reports.

Pope Benedict XVI, (r.), delivers his message concluding a weeklong spiritual retreat, at the Vatican, Saturday. On Saturday, the Vatican called reports by the Italian media speculating on conspiracies and secret lobbies said to have pushed the Pope to abdicate, 'false and damaging.'

The?Vatican?on Saturday accused the Italian media of spreading "false and damaging" reports in what it condemned as a deplorable attempt to influence cardinals who will meet in a secret conclave next month to elect a new pope.

Since Pope Benedict announced his resignation on Feb. 11, Italian newspapers have been full of rumours about conspiracies, secret reports and lobbies in the?Vatican?that they say pushed the pope to abdicate.

"It is deplorable that, as we draw closer to the time of the beginning of the conclave ... that there be a widespread distribution of often unverified, unverifiable or completely false news stories that cause serious damage to persons and institutions," a?Vatican?statement said.

The Italian reports have painted an unflattering picture of the?Vatican's central administration, known as the Curia, depicting it as being full of prelates more concerned with their careers than serving the Church or the pope.

Some Church officials, speaking privately, have said foreign cardinals coming to?Rome?to choose the next pope have been alarmed over reports of corruption and might be inclined to elect someone not connected with the Curia, which is predominantly Italian.

The?Vatican?statement said the Italian media reports were an attempt to influence the outcome of the conclave through negative public opinion much like states and kings tried to influence papal elections centuries ago.

The pope has announced that he will step down on Feb. 28, becoming the first pontiff to abdicate in some six centuries.

The 85-year-old Benedict said his failing health no longer enabled him to run the 1.2-billion-member?Roman Catholic Church?as he would like.

DISCREDITING THE CHURCH

In a separate statement, Father?Federico Lombardi, the?Vatican?spokesman, said the reports were trying to "discredit the Church and its government" ahead of the conclave.

Italy's Repubblica newspaper ran a series of unsourced stories this week about the alleged contents of a secret report prepared for the pope by a commission of three cardinals who investigated the so-called Vatileaks scandal last year.

Black troops machine gun fellow white soldiers!

Here is some black history you won't read about during black history month.

http://www.thepoliticalcesspool.org/...ut-this-month/

The headline from ABC News reads, ?World War II Mutiny By Black US Troops in Australia Confirmed.?

An Australian historian has uncovered hidden documents which reveal that African American troops used machine guns to attack their white officers in a siege on a US base in north Queensland in 1942.

Information about the Townsville mutiny has never been released to the public.

About 600 African-American troops were brought to the city to help build airfields.

According to the findings, the soldiers took to the machine guns and anti-aircraft weapons and fired into tents where their white counterparts were drinking.

More than 700 rounds were fired.

At least one person was killed and dozens severely injured, and Australian troops were called in to roadblock the rioters.

7 Things Your Wife Will Love From You | Black and Married With ...

I admit I don?t always know what my wife wants from me. You should go ahead and admit it too, you don?t always know what your wife wants from you either.

My wife?s needs change all the time, and they can be hard to keep up with. What spoke to her last week, may turn her completely off this week. ?That can be frustrating, very frustrating!

The more you learn the more you realize you needed to learn

Over the years I have found there are a few consistencies in the things she loves from me. They are little things, but if done consistently they function like compounding interest over time. The return is substantial and well worth it.

I know every woman is unique in their own way, and their needs change, but the seven things I?m about to share will bless your spouse and in turn she?ll love you even more.

7 Things Your Wife Will Love From You

  1. Apologize to her. Fellas, just like me, there is something you have done wrong in the past 7 days. Find out what it is and apologize. Even if you don?t know what it is, apologize.
  2. Focus on her. ?Spend 30-minutes communicating without any distractions. Nothing but you and your spouse. No phones, no computers, no TV, no kids, no music, nothing but the two of you. (Note: do more listening than talking)
  3. Feed her. Plan, prepare, serve, and clean-up a meal specifically for your spouse. Make something your spouse likes a lot. Husbands if you don?t have the skills to prep her ?fav dish? then try ?her fav dish that you prepare.? :)
  4. Leave her. Set up a time where your spouse can spend a few hours of time to herself. If you have kids, then take the kids somewhere and stay gone for a preset period of time. If she prefers to be out of the house, then help her plan or make arrangements.
  5. Join her. Find out one thing that your wife really likes to do and do it with her. If she has a favorite TV show, watch it with her. Favorite hobby or activity, do it with her.?Just make sure you do it on her terms (if she likes silence during the show, then no talking!).
  6. Relieve her. Your wife has a thousand things to do this week, and a million things on her mind. Be domestic sexy, provide a break for her by taking on at least one thing she normally does.
  7. Compliment her. Every day, every week, every month your wife does things that are to be appreciated, but nothing is said. ?Look for opportunities to compliment your wife?on these everyday things, not just the ?big? things.

Marriage is your most important relationship, second to God, and it should be treated as such. I encourage you to do each of the 7 things, and watch the extraordinary results which follow. Do them so much they become habits, and watch your marriage change for the better.

BMWK ? What will you do over the next week that your wife will love from you? Wives, what would you love your husband to do over the next week?

WikiLeaks discover ties between Nigerian scammers and Straftor

Sort of.

About a year ago, Julian Assange's WikiLeaks, the anti-secrecy organization that became a global sensation with the release of tens of thousands of US diplomatic cables and military field reports, said it had hit paydirt again: Seven years worth of emails from the private consulting firm Stratfor, about 5 million in all, that were stolen by hackers.

It had been 24 months since the big leaks, which the US alleges were orchestrated by Pvt. Bradley Manning, a soldier currently detained awaiting trial by the army on charges that include aiding the enemy, theft of public records, and computer fraud. On Saturday, Private Manning will enter his 1,000th day of detention. Mr. Assange has fared relatively better. Neither he nor anyone at WikiLeaks has been charged with the release of the US documents, but after losing an extradition battle in the UK over sexual assault allegations he faces in Sweden, he fled to Ecuador's London embassy, where he's lived for the past 8 months.

Nevertheless, most of his energy and that of WikiLeaks have been tied up in his fight against extradition to Sweden (he insists that the allegations, stemming from complaints from two women, are spurious and part of a conspiracy between the US, UK, and Sweden) and leaks have been few and far between.

He had hoped that the Stratfor emails would get WikiLeaks back on track, and trumpeted them as a major anti-secrecy coup. But he and his supporters don't appear to understand that Stratfor, its own PR to the contrary, is less of an intelligence player and more of an analyst of open sources. Few of the thousands of emails of Stratfor's that WikiLeaks have released in the past year have garnered much press attention. That's mostly because, unlike the US cables, they aren't very interesting.

As I wrote in a piece on this a year ago:

Assange thinks he's hit paydirt again, with seven years of emails stolen from the Texas-based Stratfor, a company that provides intelligence and geopolitical analysis. Stratfor says it generates its own intelligence for reports, though it also relies heavily on open-source data collection. I've read dozens of their reports over the years. I've found some wildly speculative, others accurate but banal, and still others intriguing.

And while I've found some Stratfor analysis to be flat wrong, and so perhaps harmful if conclusions are taken by policymakers at face value, I've never seen anything nefarious or dangerous. Yet today, the Internet is filled with claims that the Stratfor is some kind of "shadow CIA," with ominous warnings about its hidden influence and function.

Today comes a rather humorous example with a potentially alarming undercurrent (that I'll explain in a minute). Today WikiLeaks released some new Stratfor emails (it's labeling the Stratfor dump, rather self-importantly, the "Global Intelligence Files.") That caught the eye of a supporter who tweeted "New #Stratfor docs: US soldier stealing $22M from Iraq?" This was duly retweeted by the main WikiLeaks account.

That's pretty eye catching, right? Well, until you open the file.

It begins with a wry comment from a Stratfor employee, who was forwarding something on to his colleagues "Now they're getting really creative - anyone want to help a poor soldier get rid of some money?" The forwarded text has the subject line "Dear Friend," and begins:

My name is Sgt.Walter Evans, an American soldier; with Swiss Background, serving in the military of the 3rd Infantry Division in Iraq with a very
?desperate need for Assistance. I and my partners moved one of the boxes containing funds which we believe is belonging to Saddam Hussein in March 2003, the total fund in this box is (TWENTY-TWO MILLION UNITED STATE DOLLARS), this fund had been moved via a safe Diplomatic Courier Service to a secured security company...
?
?Basically since we are working for the American government we cannot keep these funds, we are Three (3) persons in involved. This means that you will take 25% percent and 75% will be for me / my partners.

Anyone who has used email since the mid-1990s will immediately recognize this for what it is: a variant of the Nigerian scam, a con-artist come-on that always revolves around some prince/lucky treasure hunter/disgraced politician/international banker who promises you an enormous financial windfall if you'll just come to his assistance with some money up front (to facilitate the eventual transfer of the loot to his "dear friend.") This isn't intelligence, it isn't even analysis. It's spam. And that's obvious to any media literate person who reads the first two sentences.

Now we get to the alarming part. When WikiLeaks released the US embassy and military documents, it failed to take steps to protect the identities of confidential sources to US officials, putting people in country's across the word at potential danger for reprisal killings or arrest. That's one of the reasons the army charged Manning (still not convicted of any crime) with aiding the enemy.

While I'm of the opinion that the odds of anything potentially dangerous being found in the Stratfor emails is very, very low, this release is a sign that there's next to no vetting going on. Since WikiLeaks, unlike me, believes there's big secrets lurking in this stuff, shouldn't they be taking steps to read stuff before they release it? And if they are, how on earth did this get by them?

It's been a rough time for Mr. Assange and his organization. Earlier this month, Jemima Khan, an associate editor of The New Statesman in the UK, became the latest in a string of stalwart supporters of Assange to abandon ship. She was one of the people who had posted bail for Assange while he fought extradition and lost the money when he fled to the Ecuador Embassy. On February 7, she wrote:

It may well be that the serious allegations of sexual assault and rape are not substantiated in court, but I have come to the conclusion that these are all matters for Swedish due process and that Assange is undermining both himself and his own transparency agenda ? as well as doing the US department of justice a favour ? by making his refusal to answer questions in Sweden into a human rights issue. There have been three rounds?in the UK courts and the UK courts have upheld the European Arrest Warrant in his name three times. The women in question have human rights, too, and need resolution. Assange?s noble cause and his wish to avoid?a US court does not trump their right to be heard in a Swedish court.?I don?t regret putting up bail money for Assange but I did it so that he would be released while awaiting trial, not so that he could avoid answering to the allegations.

She concluded her piece by writing that "it would be?a tragedy if a man who has done so much good were to end up tolerating only disciples and unwavering devotion, more like an Australian L Ron Hubbard." The Stratfor emails, for now at least, are not going to do much to turn things around for Assange.

Mosquitoes 'ignore insect repellent'

The widely-used insect repellent Deet appears to be losing its effectiveness against mosquitoes, scientists say.

Researchers from the London School of Hygiene and Tropical Medicine say mosquitoes are first deterred by the substance, but then later ignore it.

They say more research is needed to find alternatives to Deet, which was first developed by the US military.

The research was carried out on Aedes aegypti, a species of mosquito that spreads dengue and yellow fever.

The findings are published in the journal Plos One.

Dr James Logan from the London School of Hygiene and Tropical Medicine, said: "The more we can understand about how repellents work and how mosquitoes detect them, the better we can work out ways to get around the problem when they do become resistant to repellents."

Human bait

Deet - or N,N-diethyl-meta-toluamide - is one of the most widely used active ingredients in insect repellents. It was developed by the US military, following its experience of jungle warfare during World War II.

For many years, it was not clear exactly how the chemical worked, but recent research suggests that insects simply do not like the smell.

However, there are concerns that some mosquitoes are growing resistant to it.

To find out more, researchers from the London School of Hygiene and Tropical Medicine took some A. aegypti mosquitoes in the laboratory, and tempted them with a human arm covered in Deet.

As expected, the repellent put the insects off their potential meal.

However, a few hours later when the same mosquitoes were offered a chance to dine again, the researchers found that the Deet was less effective.

To investigate why this might be happening, the researchers attached electrodes to the insects' antenna.

Dr Logan explained: "We were able to record the response of the receptors on the antenna to Deet, and what we found was the mosquitoes were no longer as sensitive to the chemical, so they weren't picking it up as well.

"There is something about being exposed to the chemical that first time that changes their olfactory system - changes their sense of smell - and their ability to smell Deet, which makes it less effective."

Arms race

Earlier research by the same team found that genetic changes to the same species of mosquito can make them immune to Deet, although it was not clear if there were any mosquitoes like this in the wild.

Dr Logan said it was vital to understand both these permanent genetic and temporary olfactory changes that were taking place.

He said: "Mosquitoes are very good at evolving very very quickly."

He stressed that the findings should not stop people from using Deet in high risk areas, but that they would help scientists who are trying to find new versions that could be effective.

To follow up on the study, the researchers now plan to find out how long the effect lasts after the initial exposure to the chemical.

The team would also like to study the effect in other mosquitoes, including the species that transmit malaria.

Caves point to thawing of Siberia: Thaw in Siberia's permafrost may accelerate global warming

Feb. 21, 2013 ? Evidence from Siberian caves suggests that a global temperature rise of 1.5 degrees Celsius could see permanently frozen ground thaw over a large area of Siberia, threatening release of carbon from soils, and damage to natural and human environments.

A thaw in Siberia's permafrost (ground frozen throughout the year) could release over 1000 giga-tonnes of the greenhouse gases carbon dioxide and methane into the atmosphere, potentially enhancing global warming.

The data comes from an international team led by Oxford University scientists studying stalactites and stalagmites from caves located along the 'permafrost frontier', where ground begins to be permanently frozen in a layer tens to hundreds of metres thick. Because stalactites and stalagmites only grow when liquid rainwater and snow melt drips into the caves, these formations record 500,000 years of changing permafrost conditions, including warmer periods similar to the climate of today.

Records from a particularly warm period (Marine Isotopic Stage 11) that occurred around 400,000 years ago suggest that global warming of 1.5?C compared to the present is enough to cause substantial thawing of permafrost far north from its present-day southern limit.

A report of the research is published in this week's Science Express. The team included scientists from Britain, Russia, Mongolia and Switzerland.

'The stalactites and stalagmites from these caves are a way of looking back in time to see how warm periods similar to our modern climate affect how far permafrost extends across Siberia,' said Dr Anton Vaks of Oxford University's Department of Earth Sciences, who led the work. 'As permafrost covers 24% of the land surface of the Northern hemisphere significant thawing could affect vast areas and release giga-tonnes of carbon.

'This has huge implications for ecosystems in the region, and for aspects of the human environment. For instance, natural gas facilities in the region, as well as power lines, roads, railways and buildings are all built on permafrost and are vulnerable to thawing. Such a thaw could damage this infrastructure with obvious economic implications.'

The team used radiometric dating techniques to date the growth of cave formations (stalactites and stalagmites). Data from the Ledyanaya Lenskaya Cave -- near the town of Lensk latitude 60?N -- in the coldest region showed that the only period when stalactite growth took place occurred about 400,000 years ago, during a period with a global temperature 1.5?C higher than today. Periods when the world was 0.5-1?C warmer than today did not see any stalactite growth in this northernmost cave, suggesting that around 1.5?C is the 'tipping point' at which the coldest permafrost regions begin to thaw.

Dr Vaks said: 'Although it wasn't the main focus of our research our work also suggests that in a world 1.5?C warmer than today, warm enough to melt the coldest permafrost, adjoining regions would see significant changes with Mongolia's Gobi Desert becoming much wetter than it is today and, potentially, this extremely arid area coming to resemble the present-day Asian steppes.'

Using 3-D printing and injectable molds, bioengineered ears look and act like the real thing

Feb. 20, 2013 ? Cornell bioengineers and physicians have created an artificial ear -- using 3-D printing and injectable molds -- that looks and acts like a natural ear, giving new hope to thousands of children born with a congenital deformity called microtia.

In a study published online Feb. 20 in PLOS One, Cornell biomedical engineers and Weill Cornell Medical College physicians described how 3-D printing and injectable gels made of living cells can fashion ears that are practically identical to a human ear. Over a three-month period, these flexible ears grew cartilage to replace the collagen that was used to mold them.

"This is such a win-win for both medicine and basic science, demonstrating what we can achieve when we work together," said co-lead author Lawrence Bonassar, associate professor of biomedical engineering.

The novel ear may be the solution reconstructive surgeons have long wished for to help children born with ear deformity, said co-lead author Dr. Jason Spector, director of the Laboratory for Bioregenerative Medicine and Surgery and associate professor of plastic surgery at Weill Cornell in New York City.

"A bioengineered ear replacement like this would also help individuals who have lost part or all of their external ear in an accident or from cancer," Spector said. Replacement ears are usually constructed with materials that have a Styrofoam-like consistency, or sometimes, surgeons build ears from a patient's harvested rib. This option is challenging and painful for children, and the ears rarely look completely natural or perform well, Spector said.

To make the ears, Bonassar and colleagues started with a digitized 3-D image of a human subject's ear, and converted the image into a digitized "solid" ear using a 3-D printer to assemble a mold.

This Cornell-developed, high-density gel is similar to the consistency of Jell-o when the mold is removed. The collagen served as a scaffold upon which cartilage could grow.

The process is also fast, Bonassar added: "It takes half a day to design the mold, a day or so to print it, 30 minutes to inject the gel, and we can remove the ear 15 minutes later. We trim the ear and then let it culture for several days in nourishing cell culture media before it is implanted."

The incidence of microtia, which is when the external ear is not fully developed, varies from almost 1 to more than 4 per 10,000 births each year. Many children born with microtia have an intact inner ear, but experience hearing loss due to the missing external structure.

Spector and Bonassar have been collaborating on bioengineered human replacement parts since 2007. The researchers specifically work on replacement human structures that are primarily made of cartilage -- joints, trachea, spine, nose -- because cartilage does not need to be vascularized with a blood supply in order to survive.

"Using human cells, specifically those from the same patient, would reduce any possibility of rejection," Spector said.

He added that the best time to implant a bioengineered ear on a child would be when they are about 5 or six 6 old. At that age, ears are 80 percent of their adult size. If all future safety and efficacy tests work out, it might be possible to try the first human implant of a Cornell bioengineered ear in as little as three years, Spector said.

Quit Smoking -- The Benefits Are Huge For Older Adults, Study Says

Good news for older people who smoke: If you quit smoking, you will reap the benefits in a fairly short period of time.

A new study by researchers at the German Cancer Research Center of 8,807 people between 50 and 74 found that a person slashes their risk of heart attack and stroke by more than 40 percent within the first five years after the last cigarette.

"We were able to show that the risk of smokers for cardiovascular diseases is more than twice that of non-smokers," Professor Hermann Brenner said in a press release. "However, former smokers are affected at almost the same low rate as people of the same age who never smoked.

"Moreover, smokers are affected at a significantly younger age than individuals who have never smoked or have stopped smoking," he added.

For example, a 60-year-old smoker has the same risk of heart attack as a 79-year-old non-smoker and the same risk of stroke as a 69-year-old non-smoker. The number of cigarettes smoked and the duration of the habit also have an impact on disease risk. The more cigarettes a smoker consumes per day over a prolonged period of time, the higher his or her risk climbs.

According to researchers, the study's results suggest that smoking cessation programs -- which have been designed largely with younger people in mind -- should be expanded to reach out to older people as well.

The study looked at people who had never suffered a heart attack or stroke, and then evaluated their physical condition for up to 10 years afterwards. In their evaluation, the scientists also considered the effects of other factors such as age, gender, alcohol consumption, education and physical exercise as well as blood pressure, diabetes, cholesterol levels, body height and weight.

Another smoking-related report released by the German Cancer Research Center last year suggested that smoking was linked to increased mortality in older people and that stopping smoking was linked with reduced mortality at an older age.

For people in general, studies show there are all sorts of benefits to stopping smoking including an almost immediate drop in heart rate and blood pressure. There are also other rewards such as whiter teeth and better breath.

Pistorius May Become South Africa's O.J.

On my first night in Johannesburg, I accidentally shut the rape door behind me, trapping myself in the bedroom.

It was funny for a minute. Then I realized that since all the windows in the bedroom were barred, I had no way to get out in case of a fire.

Lawyers: NYPD's Muslim spying violates 1985 pact

NEW YORK (AP) ? Civil rights lawyers urged a judge Monday to stop the New York Police Department from routinely observing Muslims in restaurants, bookstores and mosques, saying the practice violates a landmark court case that banned political surveillance of anti-war protesters in the 1960s and '70s.

The city responded by saying it follows the law, but some legal experts say it might be time to look more closely at police practices as the Sept. 11 attacks fade into history.

"This filing is coming at the same time that I think Americans in general are beginning to see their way past the 9/11 era and the fears that engendered," said Karen Greenburg, director of the Center on National Security at Fordham Law School.

The court papers in U.S. District Court in Manhattan seek a court order against additional surveillance of Muslims without evidence of crimes and a new court-appointed auditor to oversee police activities that were "flagrant and persistent."

The civil rights lawyers complained that the NYPD has monitored public places where Muslims eat, shop and worship and has kept records and notes about their observations despite any evidence of unlawful or terror-related activities. The NYPD's actions violate rules, known as the Handschu guidelines, that a court had imposed in a 1985 landmark settlement, the lawyers said.

NYPD spokesman Paul Browne said in a statement: "The NYPD adheres to the Constitution in all it does, and specifically the Handschu guidelines in the deployment of undercover officers to help thwart plots against New York City and to identify individuals engaged in support of terrorism." The statement made no reference to informants, which the department has also used.

Browne added that terrorists have tried to attack New York City since the World Trade Center was destroyed, including plots to destroy the Brooklyn Bridge, to blow up the Federal Reserve Bank and to kill American soldiers returning home to New York.

City lawyer Celeste Koeleveld said the police department "considers the Handschu requirements carefully to ensure that all of its law enforcement actions conform to them."

The civil rights lawyers said there was "substantial evidence" that the police department had for years been using intrusive methods to conduct investigations into organizations and individuals associated with Islam and the Muslim community in New York even though there were no signs of unlawful activity.

NYPD Commissioner Raymond Kelly has said the department has plenty of oversight, including five district attorneys, a committee that investigates police corruption, the NYPD's own internal affairs office and the court-imposed Handschu guidelines.

In a speech last year to Fordham Law School alumni that was posted on the NYPD website, Kelly offered a spirited defense of its surveillance tactics, quoting the Handschu guidelines as saying that in pursuit of intelligence gathering: "The NYPD is authorized to visit any place and attend any event that is open to the public" and "to access online sites and forums on the same terms ... as members of the public."

He added: "Anyone who intimates that it is unlawful for the police department to search online, visit public places, or map neighborhoods has either not read, misunderstood, or intentionally obfuscated the meaning of the Handschu guidelines."

The NYPD is the largest police department in the nation, and Bloomberg has held up its counterterrorism tactics as a national model.

The spying was the subject of a series of stories by The Associated Press that revealed the NYPD intelligence division infiltrated dozens of mosques and Muslim student groups and investigated hundreds. The civil rights lawyers' new court motion refers repeatedly to the AP's reporting and includes some internal NYPD documents the AP had obtained and published.

The motion focuses on a particular section of the NYPD's intelligence division known initially as the Demographics Unit and later renamed the Zone Assessment Unit. This unit is at the heart of the NYPD's spying program, built with help from the CIA. It assembled databases on where Muslims lived, shopped, worked and prayed. Police infiltrated Muslim student groups, put informants in mosques, monitored sermons and catalogued every Muslim in New York who adopted new, Americanized surnames.

Supporters said the Demographics Unit was central to keeping the city safe, though a senior NYPD official testified last year that the unit never generated any leads or triggered a terrorism investigation.

Matthew C. Waxman, a professor at Columbia Law School who specializes in national security law and has spoken of the role of local police in anti-terrorism efforts, called counterterrorism "inherently and inevitably somewhat of a local police concern" because it's a threat to local security and because local police often have the relationships needed to uncover possible plots.

"On the other hand, aggressive police surveillance or even just perceived surveillance can alienate local communities and cause to dry up the very sources of information so critical to countering terrorism," he said.

Civil rights attorney Ron Kuby, who has represented several Muslims caught up in terrorism cases, said Kelly's calculus is probably shared by most New Yorkers: "If I over-police, I tread on civil liberties and people complain and file lawsuits. If I under-police, there's a smoking crater in Manhattan and thousands are dead. Gee, what should I do?"

He praised the civil rights lawyers for bringing the Handschu action, saying it was time to restore some of the "damage to the constitutional fabric of America" after the Sept. 11 attacks.

But he added a little praise for Kelly too: "I share the general feeling of the citizenry of saying he does a good job of making sure we haven't been blown up on our way to work."

The Handschu guidelines came out of a lawsuit the civil rights lawyers filed and a subsequent 1985 court settlement that set strict time limits for investigations, imposed rules on the kinds of records police could keep and created a three-person body to oversee such investigations.

Handschu was a reference to lead plaintiff Barbara Handschu in a case that included 1960s radical activist Abbie Hoffman among its plaintiffs.

It was not immediately clear when the judge will make a ruling on the new motion.

New keyboard BlackBerry in US could take months

TORONTO (AP) ? A modern BlackBerry with a physical keyboard might not arrive in the U.S. until May or June, a month or two behind other parts of the world, the chief executive of the smartphone maker suggested in an interview.

Although Research in Motion Ltd. CEO Thorsten Heins said the exact release date will depend on each wireless provider, he said the physical keyboard version, the BlackBerry Q10, will likely come out eight to 10 weeks after a carrier releases a model with only a touch screen, the BlackBerry Z10. The Z10 is expected in the U.S. in mid-March, so eight to 10 weeks brings the U.S. date for the Q10 to mid-May to early June.

"We're trying to get it as close as we can," Heins said in an interview this week with The Associated Press.

Both models are part of RIM's attempt at a comeback after the pioneering brand lost its cachet not long after Apple's 2007 release of the iPhone, which reset expectations for what a smartphone should do.

RIM promised a new system called BlackBerry 10 to catch up, using technology it got through its 2010 purchase of QNX Software Systems. But it has taken more than two years to unveil new phones that are redesigned for the new multimedia, Internet browsing and apps experience that customers are now demanding.

RIM said last week that the Q10 should be available through some carriers around the world in April, but it wouldn't say at the time whether any were in the U.S.

In the interview, Heins said it was up to the carriers to do the necessary testing and to decide whether they could shorten the process. He said eight to 10 weeks after the Z10 launch was "a good range" of what to expect.

Such a delay would further complicate RIM's efforts to hang on to customers tempted by Apple's trend-setting iPhone and a range of devices running Google's Android operating system. Even as the BlackBerry has fallen behind rivals in recent years, many BlackBerry users have stayed loyal so far specifically because they prefer a physical keyboard over the touch screen found on the iPhone and most Android devices. But the temptations to switch grow with each additional delay, despite favorable reviews for the new system.

Heins told the AP that he's disappointed the touch-only BlackBerry won't be released in the United States until mid-March, but he said the U.S. and its phone carriers have a rigid testing system.

"We need to respect that. Am I a bit disappointed? Yeah, I would be lying saying no. But it is what it is, and we're working with all our carrier partners to speed it up as much as we can," Heins said in Monday's interview at the Ritz Carlton in Toronto, ahead of Tuesday's debut of the touch-only model in Canada, RIM's home.

RIM unveiled new BlackBerrys last week after excruciating delays allowed Apple Inc., Samsung Electronics Co. and others to build commanding leads in the industry. The stock fell 12 percent last Wednesday after the kickoff event. There's concern the phone isn't coming out sooner than the March date for the U.S. announced last week.

Black and white versions of the touch-screen Z10 were released in the U.K. last Thursday. Heins said early data suggest that a substantial number of U.K. users are moving from other systems to BlackBerry, even though RIM initially targeted longtime BlackBerry users.

"It's beyond expectations," Heins said in the interview. "White is sold out already. The black is hard to stock up again. It's very encouraging. I won't share the number because I need to verify it, but we are getting a substantial number of users moving from other platforms to BlackBerry."

In Canada, telecom provider Bell said advance orders for the Z10 exceeded that of any previous BlackBerry model. "We're seeing intense interest today," Bell spokesman Mark Langton said Tuesday. "Sales are quite robust."

RIM's stock increased more than 8 percent to $16.23 in afternoon trading Tuesday after closing up 15 percent Monday following initial reports of strong U.K. sales and an upgrade of the stock by an analyst.

Heins said the company would have to regain market share in the U.S. for BlackBerry to be successful. The U.S. has been one market in which RIM has been particularly hurting, even as the company is doing well in many places overseas. According to research firm IDC, shipments of BlackBerry phones plummeted from 46 percent of the U.S. market in 2008 to 2 percent in 2012. The iPhone and Android now dominate.

Heins, who one year ago replaced longtime executives who had presided over BlackBerry's fall, said he's confident BlackBerry can become a third choice behind the iPhone and Android.

"We need to win back market share to be relevant," Heins said. "We have to be aggressive in the U.S. market."

To send a message that the BlackBerry is back, RIM ran an ad during Sunday's Super Bowl game in the U.S. suggesting that there's so much the new phones could do, it'd be easier to list the outlandish things that they can't. The Canadian company is also in the process of changing its name to BlackBerry to emphasize that brand.

Some analysts have questioned RIM's decision to release a touch-only version first considering that its most loyal users love the physical keyboard for typing.

Heins said the full touch screen was more complicated, so the company needed to focus on releasing that first. He has also acknowledged that RIM failed to quickly adapt to the emerging "bring your own device" trend, in which employees bring their personal touch-screen iPhones or Android devices to work instead of relying on BlackBerrys issued by their employers

Heins said the company wants to participate in that trend by releasing a touch version first.

Heins also addressed possible interest other companies might have in RIM should BlackBerry 10 prove successful and whether the Canadian government might block a foreign takeover.

"The recognition for BlackBerry 10 and what we built is pretty high. We got good reviews," he said. "That moves you into the middle of the radar screen so I expect some activity around it but we'll look at it one by one. We'll assess it and we'll make decisions with the board on what make sense."

Heins recently chatted with top Canadian government officials, including the industry minister, at the World Economic Forum in Davos.

"These guys are reasonable, rational people. At the end of the day, it's about employment. It's about economic health. It's about Canada playing a major role," Heins said. "If the right logic and rational applies, I don't think they will just block it for their own sake. They could have done it with Nortel and the patents."

Several months ago, RIM's decline evoked memories of Nortel, a former Canadian tech giant, which declared bankruptcy in 2009 and was picked over for its patents. For RIM, the lengthy delays releasing the new BlackBerry system helped wipe out more than $70 billion in shareholder wealth and 5,000 jobs.

Using PicMonkey With Scrapbook Pages

I have used PicMonkey to make online Scrapbook pages for a while now. I haven't really given you a tutorial though on how to use the pages for yourself so I thought I should do that now. Please note; these pages will work for an online Scrapbook but because of the size of each page you can't print it. You can re-size them before you add your photos if you want to print them. If anyone knows of a way to print out full size pages please share with me!

You use these pages just like you would a photo; saving them, attaching them, Facebooking them just like a photo. Of course, you will want to put your photos on them and some text too. ?I put together a simple page to use for this tutorial.

Start by right clicking on the scrapbook pages you want to use along with the Snowed In Color Palette and saving them to your computer as an image (save image as...). Go to PicMonkey and choose 'Edit a Photo'. Choose a saved scrapbook page for your base sheet.?
If you want to print it from your computer later, then resize it first. Change the size to 607 x 758 for an 8 x 10 when printed. Apply.
Or you can crop it to 8 x 10 though you will lose some design.?Now choose 'overlays-your own' and upload the Snowed In Color Palette. This will be your color palette for your page.?You won't keep it on your page, it is just for referral while choosing our design colors.
Enlarge the uploaded color palette a little and put it on the side out of your way. You can?completely?move it off the page and it will still be there unseen should you want to pull it back onto your page to pick a color from it.?

Now choose 'overlays-geometric' and click the rectangle. Size it by left clicking and holding onto the outer edge and pulling it. Just guess what size you want, you will be able to move or change the size later if you want.?

Decide the color you want it to be and click on the color bar anywhere then on the right vertical bar. Your cursor becomes a dropper. Take it to the color palette and choose your color; the rectangle becomes the color you clicked on.?

Now right click on the rectangle and choose 'Duplicate overlay' and click for the amount of photos you want. (I chose to have 3) Re-size and position them.?
Now choose 'overlays-your own' and upload your photos and position them.
The text option is the P on the left side. Choose your font; I used Playball. Type your text and then click it again to select it (it will have a blue background behind it) and you can then change the size by sliding the sizing button left or right. You can also change the color now too. Click on the rainbow bar to choose or use the dropper to pick your color from your color palette. You can add text any where on the page including over the photos, each one can be a different font or color that you want.?
Play with other option to decorate and personalize your pages. When a feature has this little orange crown, it is a membership only feature. ?When you are finished decorating, give your page a name and save it to your pictures. You will want to make sure the Color Palette is completely off the page or deleted before you save your page.?

Choose the 'overlay-your own' to upload other scrapbook pages and combine them for your own designs.

I rarely use the 'merge' option - I just save as it is to my computer then I can make changes if I want while it is still on PicMonkey. If I?merge?it then you can't make any changes.
Here is my finished page. This page can now be added to any online album or uploaded on Facebook or attached in a email. I can use it just like a photo. I hope you enjoyed my tutorial and pages!

I have other post about using PicMonkey; here is a tutorial how to make your own scrapbook pages.?
